You may be in good health now, but we never know what the future holds, so it's important to take steps to plan your financial future. It's also a good idea to set up these arrangements sooner rather than later, not only for your own peace of mind, but for the benefit of your family.

Why have a Will?

Many people assume that their spouse and/or children will automatically receive all their estate should they die without a Will. Surprisingly, this isn’t always the case; there are strict intestacy laws which dictate who gets what should you die without a Will. By preparing for the future and planning your estate now, you can ensure that your estate is divided according to your wishes. You can also ensure that the people you wish to omit from your Will do not receive any of your estate.

A Will gives you the opportunity  to clearly detail specific gifts for friends, relatives or charities, and you can also express your funeral wishes (such as if you would prefer to be buried or cremated, for example). It is also important to remember that by appointing your own Executors, instead of using solicitors, you will leave more money in saved legal fees for your beneficiaries to share.

What is a Lasting Power of Attorney?

Your ‘Lasting Power of Attorney’ documents are also very important. We never know what life holds so arranging your LPAs while you are fit and well is the best time. There are two different types of LPA:

  1. A Health & Welfare LPA allows your attorneys to make important decisions about your welfare only if you should become mentally incapable of doing so yourself.
  2. A Property & Finance LPA allows attorneys, chosen by you, to look after all of your finances at any time of your life. You might choose not to look after them yourself any longer, or it can be a safeguard in the event you can no longer make these important financial decisions for yourself.

The latter is particularly important if you have taken equity out of your house, as you can choose those closest to you to sign on your behalf should you need to release further funds that are required in the future.
